The Labour Appeal Court's decision in Enever v Barloworld Equipment overturned a previous ruling that upheld the dismissal of an employee based on a positive cannabis test. This decision stems from the earlier Prince case, where the Constitutional Court decriminalized the private use of cannabis, raising questions about the fairness of drug testing policies that do not differentiate between legal, private use and workplace impairment.
